An opportunity has arisen for an Associate to join the Technology, Media and Telecommunications Team in the Corporate and Commercial Department at the Johannesburg offices of ENS. Overview The candidate must have proven experience and expertise in technology, media and telecommunications law as well as data privacy law. In addition to the above, the candidate should be achievement oriented, focused and able to work under pressure in a deadline driven environment. The Work The candidate will be expected to assume responsibility for working closely with clients as well as managing elements of various transactions. As such, this role will offer the candidate an opportunity to obtain experience in cutting edge technology transactions, data privacy matters and TMT regulatory work. Key Responsibilities Assisting with POPIA related matters, including drafting of complex opinions and assisting with POPIA implementations; Assist with vetting, negotiating and drafting of agreements in the TMT sector; Advising on fintech related matters; Advising on regulatory matters in the TMT sector; Researching law and drafting opinions; Assistance with due diligence matters; Attend independently to smaller matters and aspects of larger matters; Experience in technology transactions – drafting, vetting and negotiating TMT related contracts as well as opinion work; Proven knowledge and experience with POPIA, PAIA, Cybercrimes Act and related legislation; Working knowledge of ECTA, ECA, CPA and related legislation; Experience in social media legal issues. Skills, Abilities and Experience A thorough knowledge of the law – with at least 1 year proven experience in TMT law and data privacy law experience / knowledge (post articles); Proven and demonstrable experience in working on technology transactional matters, including drafting and vetting of TMT related agreements as well as opinion work (non-negotiable); Thorough and extensive knowledge of POPIA and PAIA or similar data privacy legislation such as GDPR; Proven demonstrable experience on working on data privacy related matters; Telecommunications regulatory experience an advantage; Strong written and verbal communications skills with some experience in negotiations; Confidence, initiative and the ability to run matters independently; Strong contract drafting and vetting skills (non-negotiable); Relevant work experience in a law firm; A passion for TMT law; Interest in presenting on areas of law, attending conferences, drafting articles; Strong analytical skills; The ability to self-regulate; The ability to work in a fluid and fast paced environment; The ability to work in a diverse team and with diverse clients; The ability to work under pressure in a demanding environment; Excellent communication skills and client interaction skills (both verbal and written); Knowledge of telecommunications and / or broadcasting regulatory issues, including ICASA related procedures (advantageous). In addition to the above, it is essential that the candidate also demonstrate an ability to manage client relations, billing processes and practice management in general.
