An opportunity has arisen for a Regulatory Attorney at Associate / Senior Associate / Salary Director level to join our Banking and Finance Regulatory Department in Team Itzikowitz in Cape Town. THE WORK The successful candidate will be exposed to a wide variety of financial services regulatory work, including advising banks, insurers, fintechs and capital markets participants on licensing, conduct, prudential and market integrity matters. If appointed, the candidate will develop exceptional technical skills in specialised areas of financial sector regulation, with a strong focus on crypto assets, payments, open finance and open baning, BaaS and the Conduct of Financial Institutions (COFI) framework. The candidate will gain experience advising on licensing applications, regulatory engagements with the Prudential Authority, the Financial Sector Conduct Authority, the South African Reserve Bank and the FIC, as well as on the regulatory aspects of banking, insurance, collective investment schemes, derivatives and fintech products. The successful candidate will work on matters involving a wide array of local and global financial institutions. KEY RESPONSIBILITIES Drafting regulatory opinions, policies, frameworks and submissions to regulators Managing licensing applications, regulatory approvals and engagements with financial sector regulators Extensive legal research and advising on all aspects of South African financial services legislation Advising specifically on the Banks Act, the Financial Sector Regulation Act, COFI, the FAIS Act, the Financial Markets Act, the Insurance Act, the National Payment System Act, data privacy and anti-money laundering legislation. A thorough understanding of contract law. An understanding of crypto assets and AI. A sound understanding of administrative law and regulatory decision-making processes, including PAJA Attending independently to smaller regulatory matters and aspects of larger advisory mandates Assisting senior team members on complex regulatory and policy mandates Drafting contracts and loan agreements Skills, abilities and experience Admitted Attorney Fintech and its various forms including a thorough understanding of payments. Crypto assets including tokenisation. National Credit Act The Conduct of Financial Institutions (COFI) The Financial Advisory and Intermediary Services (FAIS) Act Financial Markets Act Protection of Personal Information Act Insurance Legislation.
